Terms of Sale

1. Introduction

These Terms of Sale apply to the purchase of tickets for events promoted by UPNXT Pty Ltd (ABN 82 683 129 099) (“UPNXT”, “we”, “our” or “us”).

By purchasing a ticket to any event promoted by UPNXT, you agree to be bound by these Terms of Sale, together with any Event Specific Terms, Venue Terms and Conditions and the terms of the Authorised Ticketing Provider.

If there is any inconsistency between these documents, the following order will apply:

  1. Venue Terms and Conditions
  2. Event Specific Terms
  3. UPNXT Terms of Sale
  4. Authorised Ticketing Provider Terms and Conditions

UPNXT reserves the right to cancel any ticket used in breach of these Terms.

2. Purchasing Tickets

Tickets for UPNXT events must be purchased through authorised ticketing providers listed on the official UPNXT website.

Tickets purchased through unauthorised sellers or resale websites are purchased entirely at your own risk.

UPNXT cannot guarantee the validity of tickets purchased from any source other than an authorised ticketing provider.

3. Ticket Use

Tickets may not be:

  • Resold for commercial gain where prohibited by law
  • Used for advertising, promotions or competitions without prior written approval from UPNXT
  • Copied, altered or duplicated

UPNXT reserves the right to cancel tickets obtained or used in breach of these Terms.

4. Event Specific Conditions

Certain events may have additional conditions relating to:

  • VIP experiences
  • Meet & Greets
  • Age restrictions
  • Photography
  • Merchandise
  • Entry requirements

Where applicable, these conditions will be published on the event page or by the authorised ticketing provider.

5. Event Changes

UPNXT reserves the right to:

  • Change event dates
  • Change event times
  • Change venues
  • Change seating configurations
  • Add or remove support acts
  • Alter event schedules

These changes may occur without prior notice where reasonably necessary.

6. Ticket Limits

To ensure fair access to tickets, UPNXT may impose purchase limits.

Orders exceeding published limits may be cancelled without notice, including multiple orders linked to the same customer, payment method or account.

7. Cancelled, Rescheduled or Relocated Events

If an event is cancelled, rescheduled or significantly relocated, UPNXT will comply with all applicable Australian Consumer Law requirements.

Where applicable:

  • Cancelled events may be eligible for a full ticket refund.
  • Rescheduled events will generally remain valid for the new date.
  • If you are unable to attend a rescheduled event, refunds may be available within the timeframe advised by UPNXT or the authorised ticketing provider.
  • Relocated events may also be eligible for refunds where required under Australian Consumer Law.

Refunds do not generally include travel, accommodation or other expenses incurred by ticket holders unless required by law.

8. Refunds

Refunds will only be provided where required by Australian Consumer Law or where expressly stated by UPNXT or the authorised ticketing provider.

Lost, stolen or damaged tickets may only be replaced where permitted by the authorised ticketing provider and proof of purchase is provided.

9. Incorrect Purchases

Customers are responsible for checking all event details before completing their purchase.

UPNXT is not responsible for purchases made in error, including:

  • Incorrect event
  • Incorrect city
  • Incorrect date
  • Incorrect seating selection
  • Incorrect ticket type

Refunds for customer purchasing errors are subject to the policies of the authorised ticketing provider.

10. Event Entry

Entry to an event is subject to:

  • A valid ticket
  • Venue Terms and Conditions
  • Security screening
  • Compliance with event staff directions

UPNXT and venue staff reserve the right to refuse entry or remove any person whose behaviour is unsafe, disruptive, offensive or unlawful.

No refund will be provided where entry is refused due to a breach of these Terms.

11. Photography and Filming

UPNXT may photograph, record or film events for promotional, marketing or archival purposes.

By attending an event, you consent to your image or likeness being captured and used by UPNXT without compensation.

Professional cameras, video equipment and recording devices may be prohibited unless authorised.

12. Health and Safety

All attendees enter events at their own risk.

Patrons must comply with:

  • Venue safety procedures
  • Security requirements
  • Directions from event staff
  • Emergency procedures

UPNXT reserves the right to refuse entry or remove any person who presents a safety risk.

13. Prohibited Items

For the safety and enjoyment of all patrons, prohibited items may include:

  • Weapons
  • Illegal substances
  • Fireworks
  • Laser pointers
  • Professional recording equipment
  • Drones
  • Large flags or banners
  • Glass containers
  • Alcohol not purchased within the venue
  • Any item considered dangerous by venue or event staff

Venue-specific prohibited items may also apply.

14. Limitation of Liability

To the maximum extent permitted by law, UPNXT is not responsible for any indirect or consequential loss arising from attendance at an event, including travel, accommodation or other incidental expenses.

Nothing in these Terms excludes any rights available under Australian Consumer Law.

15. Personal Information

When purchasing tickets, personal information may be collected by UPNXT and/or the authorised ticketing provider.

This information may be used to:

  • Administer your ticket purchase
  • Contact you regarding the event
  • Notify you of changes affecting the event
  • Send marketing communications where you have consented

16. Amendments

UPNXT may amend these Terms of Sale from time to time.

Updated versions will be published on our website and become effective immediately upon publication.

17. Governing Law

These Terms of Sale are governed by the laws of New South Wales, Australia.

Any disputes arising from these Terms or attendance at an event are subject to the exclusive jurisdiction of the courts of New South Wales.
